Every factory in India must be registered and licensed under the Factories Act, 1948 before it commences operations. The registration and licensing process involves the State Inspector of Factories, and the specific requirements, forms, and fees vary by state. For multi-plant companies, managing registrations across multiple states adds a layer of administrative complexity. In 2022, as several states introduce online portals for factory registration and licence renewal, HR managers have an opportunity to streamline this process, but must first understand the requirements and avoid the common pitfalls.

The Registration and Licensing Process

The process begins with the submission of a plan and notice to the Chief Inspector of Factories at least 15 days before the factory commences operations. The plan must include the site and building plan, details of manufacturing processes, plant and machinery layout, and the nature of work to be performed. Upon satisfactory review, the Chief Inspector grants approval, after which the occupier (the person who has ultimate control over the factory) must obtain an annual licence. The occupier is responsible for the factory's overall safety and compliance, and serves as the primary point of legal responsibility under the Act. The manager is responsible for day-to-day operations and must comply with the Act's provisions regarding workers. Any person who by reason of occupation, trade, business, calling, or employment takes part in the management, is deemed to be a manager. Both the occupier and manager must notify the Inspector of Factories of their details (Form 2 under most state rules) and any change in occupier or manager must be reported. Factory HR managers must maintain current records of who occupies these roles and ensure that changes are formally notified.

State-Specific Online Portals in 2022

Several states have launched or expanded online portals for factory registration and licence renewal. Gujarat's online single-window system, for example, allows factories to apply for licences, upload documents, make payments, and track application status digitally. Maharashtra's Mahaonline portal provides a similar facility. These digital systems reduce the administrative burden and processing time, but require HR managers to ensure that their documentation is in the correct digital format and that all required details match across documents. Inconsistencies between the factory's CIN, GST details, and Factories Act registration records are a common trigger for rejection or delay.

Licence Renewal Best Practices

Factories that operate on an expired licence are in violation of the Factories Act, exposing the occupier and manager to criminal liability. HR teams must maintain a compliance calendar that includes factory licence renewal deadlines, with reminders at least 60 days before expiry to allow time for documentation gathering and submission. In states where online renewal is available, the process is typically faster and more predictable. In states where physical submission is still required, building a relationship with the local Inspectorate of Factories office can be advantageous. Some states also link licence renewal to the factory's compliance record, so maintaining clean inspection records facilitates smoother renewals.
